Gary Herbert

Partner Gary Herbert leads the Serious Injury team at Price Slater Gawne, bringing with him extensive experience acting for clients who have sustained a wide range of life-changing injuries – with a particular specialism in traumatic brain injuries.

Over a career spanning more than 20 years, Gary has successfully represented both children and adults afflicted by brain injuries of all types and severities, including complex cases where earlier medical investigations were deemed inconclusive.

He developed an early passion for brain injury compensation claims during his time as a trainee and has continued to excel in this specialism throughout his career.

His claimant work has seen him lend his expertise to a number of noteworthy cases, including:

  • Successfully representing a client in a minimally conscious state, securing lifetime care and accommodation despite a reduced life expectancy and a reduction in damages due to seatbelt non-compliance
  • Representing an adult pedestrian who walked into the path of a car during ‘Freshers Week’ and securing a settlement representing the provision of 2:1 care for life
  • Achieving a settlement for an 18-year-old client with a brain injury, who experienced no physical impairments but significant memory impairment, which included provision for 1:1 care for life
  • Securing a settlement for a child injured while crossing against a red pedestrian signal, obscured by an illegally parked car. The settlement included a lump sum for 1:1 care throughout adulthood, with a claim established against the parked vehicle’s driver
  • Representing a 17-year-old female with brain injury from a car accident as a front seat passenger. The settlement included a combination of lump sum and Periodical Payment Order (PPO) to provide for 24/7 lifelong care
  • Taking over the claim of a 54-year-old male with brain injury, who had previously refused support. Gary successfully negotiated a settlement for support five days a week with lifetime care provision
  • Acting on behalf of a male who sustained severe brain injuries due to a deliberate act, with no physical impairments. The case ultimately settled with a combination of lump sum and annual payments for 2:1 care for life
  • Successfully representing the Claimant in RO (by MI) v Gray and MIB [2021] EWHC 2770 (QB)
  • Representing a young lady accused of intentionally jumping out of a moving car, securing a significant sum towards her future support needs

As a renowned leader in his field with a track record of securing significant compensation and therapy for his clients, Gary is also recognised as a Band 1 Claimant Solicitor in the North West region in the Chambers and Partners Guide.

Gary studied Law at the University of Sheffield before completing his LPC in 2000, qualifying as a Solicitor in 2002. He is a member of the Association of Personal Injury Lawyers (APIL) and – having been active with brain injury charity Headway for more than two decades – is currently secretary for two of its regional branches, Headway Salford, Trafford and North Manchester, and Headway South Cumbria.
