If the cause of the accident was the poor state of the road itself, a claim can be made to the relevant Highways Authority responsible for the upkeep of the road.
You may think you will not be able to bring a claim if the driver responsible for the collision is untraced or uninsured – but it is still possible to bring a claim against the Motor Insurers’ Bureau in some circumstances. They will step into the shoes of the untraced or uninsured driver and will pay compensation if you are eligible.
Even if you believe you may be partly at fault for the collision – it still might be possible to bring a personal injury claim. Your compensation may be reduced by a percentage to reflect that there were multiple causes of the accident.
