Changing deputy for property and financial affairs

Over the past 18 months I have dealt with numerous applications to change financial deputy. The basis of these applications is typically a breakdown in the relationship with the previous professional deputy and this can occur for a variety of reasons. Some of the common themes I have seen as causing such a breakdown relate to communication difficulties and delays in progressing decisions such as property purchases.

The role of a professional deputy is complex and often requires a nuanced balance between safeguarding and empowering the client. There needs to be a positive relationship between the deputy and the client as well as with the client’s family and any other professionals that might be involved in their welfare. These positive relationships are pivotal to progressing decisions on behalf of the client and ensuring that the decisions are made in the client’s best interests. For many, the challenges of COVID will have impacted on communications but at Price Slater Gawne, we have remained fully operational throughout the crisis supporting our vulnerable clients.

When the relationship with a deputy has broken down and is beyond repair this can cause significant frustration and lead to the delays that clients have reported to me. I have previously written about misconceptions that it is not possible to change a professional deputy and how this can provide a barrier to clients or their families exercising their wishes to change deputy. Of course, there are certain circumstances where it is not appropriate to seek a change in deputy because such a change would not be in the interests of the vulnerable client. However, I would suggest speaking to an independent solicitor and obtaining advice before deciding how you wish to proceed.

Several of the applications that I have progressed during the past 18 months started off with such a discussion and resulted in successful change in deputy. Please see below comments from satisfied clients and family members.

“Changing my mother’s deputy over to Price Slater Gawne was not a decision I took lightly, but rather one that I gave significant time, thought and consideration. – After changing deputy to them, my only regret is that I didn’t do it sooner.

My initial research into deputyship provided a raft of results but having come across an article on changing deputy by Tom Young, I was provided with the answers to many of my questions all in one place. I was then able to make use of the 24/7 online chat function offered by the company; a service which meant that I could make contact with the firm at a time that was convenient to me.

I arranged a call with Tom to discuss changing deputy and our requirements of the deputyship. From the outset I was provided with transparency and a service that was truly tailored to our needs, giving full consideration to our circumstances and developing a solution accordingly. – In my mother’s case, this was the decision to establish a joint deputyship. Following this call, I had a meeting with Tom at which, I felt my options regarding my mother’s deputyship were discussed with me in a clear, concise manner. On a day to day basis now, Tom, Jade and the team ensure that I am provided with updates as required. I feel confident that I can discuss matters with them at any time.

Whilst the COVID-19 lockdown has of course raised its challenges, the same high levels of service have been delivered, and I can say without doubt that the team are focused on helping clients.

I truly believe that anyone can have a job, but blessed are those that work not only for themselves but also to help others. – I found that the Price Slater Gawne team truly want to help their clients”.

“I desperately needed to change deputy and I appointed Tom at PSG to deal with the difficult situation I was in and take over the deputyship. Tom tackled this delicate change over very professionally and kept me updated throughout the transfer.

I could not be happier with Tom at Price Slater Gawne being my son’s deputy. He is highly professional, prompt and supportive. The team at PSG are always at hand and always ready to help. Big thanks to Caz who is very supportive and always at hand.

I would recommend PSG Solicitors to anyone who needs professional help”.
